Tender Corp. Statement Regarding FTC Settlement

Tender Corp. today issued the following statement regarding the Federal Trade Commission’s press release announcing that the company has agreed to settle a case involving biodegradable claims it made for body wipes that it sells and distributes under the Fresh Bath™ Travel Wipes and Fresh Bath™ Body Wipes brand names.

As per the settlement, which was reached in January 2009, Tender Corp. has agreed, going forward, to comply with the Commission’s consent order, which requires it to meet all FTC guidelines when using language that includes biodegradable claims in any of its advertisements, labeling, packaging and promotional materials for Fresh Bath™ Travel Wipes, Fresh Bath™ Body Wipes or any other products that the company produces or distributes.

As the FTC’s consent order states, the settlement agreement is for settlement purposes only and does not constitute an admission from Tender that it violated any law.

Tender Corp. has always followed all applicable laws and would not intentionally seek to prosper by representing its products with misleading claims.  We are now aware of the FTC stance on distributing and labeling products and will ensure that we review any new development in this area against the FTC’s requirements. This includes not only fully substantiating ‘green’ or biodegradable claims for products produced internally but also securing the requisite scientific data to buttress such claims made by suppliers for products, like Fresh Bath™ Travel Wipes and Fresh Bath™ Body Wipes,  for example, which Tender sources from a third-party vendor. In the case of the wipes, Tender relied on the supplier for substantiation of the products’ biodegradable claims.
